Terms and Conditions
RENTAL RATES:Rates are based on property features, location, and season. Rates are subject to change without notice. Rates do not include local and state taxes, a processing fee, or a housekeeping fee. These fees will be added to all reservations.
PAYMENTS:
Mountain Modern Management accepts payment by all major credit cards, cashier/certified check or ACH transfer. A deposit in the amount of 50% of the total rate, including taxes and fees, is due at time of booking. The remaining balance is due in full 30 days prior to arrival. Should your booking occur within 30 days or less of your arrival date, the full amount of the reservation will be charged at time of booking.
CANCELLATION AND REFUND POLICIES:
1. 100% refund prior to 60 days of check-in date, minus a 5% transaction processing fee.
2. 50% refund between 30 and 60 days of check-in date. Reservations made between 30 and 60 days of check-in date are subject to a 100% refund if request for refund is made within 5 days after reservation date, minus a 5% transaction processing fee.
3. Reservations canceled less than 30 days prior to check-in date are 100% non-refundable.
4. All Holiday stays are 100% non-refundable.
5. We are unable to refund or prorate based on any issues or delays including but not limited to: weather, health or other personal reasons.
REFUNDS:
We strive to keep timely and accurate property and advertising information on all our platforms. Mountain Modern Management will not be held accountable for advertising errors due to property owner updates to pricing, availability, furnishings, amenities, equipment, and bedding arrangements. Refunds will not be given due to circumstances outside the control of Mountain Modern Management. This includes mechanical failure of items such as, but not limited to, air conditioners, TV, internet, dishwashers, hot tubs or other luxury items. This includes power outages, construction from surrounding areas and acts of nature. Property is located in snow country. Local roads can be snow covered, icy, and steep. Mountain Modern Management highly recommends having a four-wheel drive vehicle with snow tires and/or chains during the winter months. Mountain Modern Management cannot refund anything due to road conditions. No refunds can be given for any item not brought to our attention prior to your departure.
CREDIT CARD INFORMATION:
Having a credit card on file is a requirement for your convenience. Additional services and/or any outstanding charges or fines due to damage not covered by the property protection plan, if purchased prior to arrival, or the breaking of the Rental Agreement will be automatically charged to the credit card on file. Balances due will be automatically charged to the credit care on file unless other payment is provided. Should the credit card on file be declined, guest agrees to immediately provide Mountain Modern Management with updated credit card information.
TRAVEL INSURANCE:
Mountain Modern Management partners with Rental Guardian to provide travel insurance options to our guests through our website reservation system. For more information about Rental Guardian and the travel insurance options offered or to file a claim, please visit their website - rentalguardian.com.
VACATION RENTAL DAMAGE PROTECTION:
Mountain Modern Management partners with Rental Guardian to provide optional property protection insurance and can be purchased through our website reservation system. For more information about Rental Guardian and their services or to file a claim please visit their website - rentalguardian.com.
GUEST RESPONSIBILITY:
The person whose name the reservation is under will accept full responsibility for all payments, deposits, and for the actions of all persons on the premises of the property during the stay.
SMOKING:
Smoking cigarettes, vaping or marijuana at any of our properties is not permitted. This includes any indoor area and outdoor area on the premises of the property. Violation of this policy will result in additional charges to return the property to an allergy-free zone, including but not limited to: steam/dry cleaning all carpeting, area rugs, drapes, bedding and linens in the entire home. Evidence of smoking during one’s stay will result in immediate eviction and forfeiture of all paid expenses. In addition, the credit card on file will be charged a minimum of $500 to cover damages incurred and any additional costs above this minimum charge will be charged to the credit card upon completion. The property will be checked for evidence of smoking after departure.
ALCOHOLIC BEVERAGES & DRUGS:
Guest agrees that there will be no illegal activities on the premises, including but not limited to: possession, serving or consumption of alcoholic beverages by anyone under the age of 21; or the possession or use of any illegal drugs. Additionally, Guest accepts full responsibility and liability and hereby indemnifies Owner and/or Mountain Modern Management for anything that happens in reference to Guest and/or Guest’s party partaking of any alcoholic beverages or drugs on the property.
PETS:
No pets are permitted at any time inside the home or outside on the property. If evidence of a pet is found during one's stay, we reserve the right to request that the pet be boarded immediately or the rental contract will be terminated. In addition, the credit card on file will be charged $250 for professional cleaning of the home.
MAXIMUM OCCUPANCY:
The maximum number of people who can be at the property is specified on the individual property listing. Mountain Modern Management is not responsible for providing accommodations, linens, or towels for additional guests outside the number of guests stated on the rental agreement. If damage occurs related due to additional guests, all charges will be the responsibility of the individual who’s name the reservation is in and will be charged to the credit card we have on file.
PARKING:
Some rentals have a strict maximum number of vehicles allowed at the property. Having additional vehicles at the property or in parking spaces unassigned to the rental may result in fines or towing. All parking is a courtesy and cannot be adjusted due to unauthorized use or oversized vehicles.
HOUSEKEEPING SERVICES:
All of our properties are cleaned to the highest of standards, prior to your arrival and after your departure. You are responsible for the cleaning of your unit during your stay. We respectfully request that you treat your vacation rental with the utmost care and leave in good condition at time of checkout. Please do not flush any sanitary napkins, tampons, wet wipes, baby wipes or paper towels down toilets in our homes. Any damages to the plumbing and sewer/septic systems that occur from flushing any of these items will be charged to our guests, accordingly.
ARRIVAL INSTRUCTIONS:
Check-in is at 4:00 PM. Early arrival must be pre-approved by Mountain Modern Management prior to arrival. Please do not enter the property before your check-in time. Arrival Instructions specific to a property, including how to access the rental, will be sent via email two days prior to arrival.
DEPARTURE INSTRUCTIONS:
Checkout is no later than 10:00 AM - a late check out fee will apply if staying past this time. Late check out is not available during peak summer seasons - June 1st through September 15th. Please call Mountain Modern Management at least 24 hours prior to departure to see if a late checkout is available. Please make sure all dirty dishes have been loaded into the dishwasher and turn the dishwasher on prior to leaving. Be sure to close and lock all outside doors and windows. If the housekeeping crew has to sit outside to wait for guests to leave the property, there will be an additional cleaning fee charge applied to the credit card on file.
SUPPLIES AND FURNISHINGS:
Properties are fully furnished including bedding, pillows, towels, and equipped kitchens unless otherwise specified. A limited starter supply of paper products, bath and dish soap are provided, but will not be replaced if consumed during your stay so we recommend bringing additional personal items with you. If there is a special type of item you are accustomed to using, please provide for those items by bringing them with you.
NOISE AND EVENTS POLICY:
Out of courtesy to neighbors, quiet hours are from 10:00 pm - 8:00 am (including but not limited to: loud music or other loud noises). Out of respect for our neighbors, large social events or gatherings (i.e. birthday parties, ceremonies, weddings, and receptions) at any of our rental properties are prohibited. Not adhering to the quiet hours or violating the events policy may result in immediate eviction and that no refund will be given for unused nights.
REPORTING ISSUES:
Please notify Mountain Modern Management of any issues found immediately. We will work to resolve the reported problems in a timely manner; however, some issues may not be able to be repaired prior to your departure. Mountain Modern Management and its vendors have the right to enter the rental property for maintenance and housekeeping concerns as well as provide entrance to service technicians.
LOST & FOUND:
Mountain Modern Management is not responsible for personal belongings left behind. Additional charges will apply for shipment of any lost items left at the property after departure that are found by Mountain Modern Management. Please contact us within 48 hours of departure if you think you may have left items at a rental.
HOT TUBS:
Guest use of any hot tub or spa assumes all risks and liability. Guests are advised that there are potential dangers to children who are not carefully supervised, as well as any person using hot tub or spa too long or if a person has health risks, is intoxicated, using any kind of drugs or medication, or is pregnant. Guests are advised that the chemicals used in the servicing and maintenance of the hot tub can lead to skin and eye irritations, rashes, and other reactions in adults and children. Guest agrees to waive any claim whatsoever against Mountain Modern Management, it's owners, contractors, employees, and associated property owners from accidents, illness, or injury arising from use of any hot tub or spa. Guest agrees that they are responsible and liable for any damages that occur to the hot tub or spa through their or their guest's misuse or negligence. Should guest or anyone visiting guest at the property contaminate the water with any foreign substance by not abiding by the rules, guest agrees to an additional charge of $250.00 to cover the cost to drain, clean and refill the hot tub and remediate the contamination to the filtering system. Each hot tub is serviced prior to arrival and the chemical levels are checked and recorded. Guest will keep the hot tub cover closed and locked when not in use.
RISK AND LIABILITY:
There are risks associated with the use of any property, which may include but are not limited to risks of injury to person or property, or death especially in a high-altitude location as this one with severe climates. Call Mountain Modern Management immediately if there is any matter about which you are uncertain or which you believe may present an unreasonable risk to you. Given the extreme winter conditions, risks around the properties may include: wet, slippery, or icy conditions both inside and out; falling snow or ice/ice cycles; actions of third parties not under the control of the property manager or unit owner; theft of, or damage to, personal property; electric shock or other injury in the use, or misuse, of any electric appliance or mechanical device; risk of injury in the use of garbage disposals and trash compactors. Renter and all persons in the rental group will assume all risk and liability. Renter agrees to the foregoing and waives all right to claim damages.
GUEST AGREEMENT:
Mountain Modern Management provides rental management services on behalf of homeowners who rent their properties (including the associated fixtures and furnishings) to guests seeking accommodations on short-term or long-term basis. We are the Owner's authorized rentals agent and will perform services related to your reservation. By using the home and the services you agree to comply with and be legally bound to the terms and conditions of this agreement. We respectfully ask that you be considerate of the owner’s belongings. Please return all household items to their original places prior to departure. Inside furniture should not be taken outside and if moved during your stay, please return to the original location. Household items and belongings should not be taken off the premises. Units may have one or more locked closets that are for owners use only, these are not included in the Rental Agreement. If damage such as tears, make-up stains, bloodstains, mud, dirt, or other evidence that our linens and towels were used carelessly then a replacement fee may apply.
INDEMNITY:
Neither Owner nor Mountain Modern Management assumes any liability for loss, theft, damage or injury to Guest, his/her guests or other occupants in the Home. The Guest, for himself/herself, his/her heirs, assignors, executors and administrators, fully releases and discharges Owner and Mountain Modern Management from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the Guest, his/her guests or other occupants of the Home as a result of, or in connection with the occupancy of the Home and agrees to hold Owner and Mountain Modern Management free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this Agreement, or their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
